Diese Bedingungen gestatten Ihnen die Nutzung der Services ausschließlich für Ihren persönlichen, nicht kommerziellen Gebrauch. Sie dürfen ohne unsere vorherige schriftliche Zustimmung keine Inhalte reproduzieren, verteilen, modifizieren, veröffentlichen, speichern, herunterladen oder übertragen. Nichts in diesen Bedingungen gewährt Ihnen eine Lizenz an geistigen Eigentumsrechten von Tobias Visuals, Shopify oder Dritten.
Tobias Visuals-Namen, Logos, Produkt- und Servicenamen, Designs und Slogans sind Marken von Tobias Visuals oder seiner Lizenzgeber. Shopify-Marken gehören Shopify. Alle anderen Marken gehören ihren jeweiligen Eigentümern.
ABSCHNITT 7 – OPTIONALE TOOLS
Sie können Zugang zu Tools von Drittanbietern erhalten, die wir weder überwachen noch kontrollieren. Sie erkennen an, dass diese Tools „wie gesehen“ und „wie verfügbar“ ohne Gewährleistung bereitgestellt werden. Wir übernehmen keinerlei Haftung aus der Nutzung solcher Tools.
Ihre Nutzung erfolgt vollständig auf eigenes Risiko. Stellen Sie sicher, dass Sie die Bedingungen der entsprechenden Drittanbieter überprüfen und akzeptieren.
Zukünftige neue Funktionen gelten ebenfalls als Teil der Services und unterliegen diesen Bedingungen.
ABSCHNITT 8 – LINKS VON DRITTANBIETERN
Die Services können Materialien und Links zu Websites Dritter enthalten. Wir sind nicht verantwortlich für die Prüfung oder Bewertung solcher Inhalte. Der Zugriff erfolgt auf eigene Gefahr.
Wir haften nicht für Schäden, die durch den Zugriff auf Websites Dritter oder Käufe, Inhalte oder Dienstleistungen solcher Websites entstehen. Lesen Sie die jeweiligen Richtlinien Dritter sorgfältig durch.
ABSCHNITT 9 – BEZIEHUNG ZU SHOPIFY
Tobias Visuals wird von Shopify betrieben, aber alle Käufe erfolgen direkt zwischen Ihnen und Tobias Visuals. Shopify ist nicht verantwortlich für Verkäufe oder Schäden im Zusammenhang damit. Sie entbinden Shopify ausdrücklich von allen Ansprüchen im Zusammenhang mit Ihren Transaktionen mit Tobias Visuals.

Alle über die Services erhobenen personenbezogenen Daten unterliegen unserer Datenschutzrichtlinie here. sowie teilweise der Datenschutzrichtlinie von Shopify. Durch Nutzung der Services erkennen Sie an, diese Richtlinien gelesen zu haben.
Shopify erhebt personenbezogene Daten über Ihre Nutzung der Services, um diese bereitzustellen und zu verbessern. Ihre eingereichten Informationen werden an Shopify und ggf. internationale Dienstleister übermittelt. Weitere Details finden Sie in unserer Datenschutzrichtlinie.

Sie versichern, dass Sie alle Rechte am Feedback besitzen, eventuelle Entlohnungen offengelegt haben und dass Ihr Feedback diese Bedingungen einhält. Wir sind nicht verpflichtet, Feedback vertraulich zu behandeln, zu bezahlen oder darauf zu antworten.
Wir können Feedback entfernen, das wir als rechtswidrig, beleidigend oder unangemessen einstufen.
Sie stimmen zu, dass Ihr Feedback nicht gegen Rechte Dritter verstößt oder schädliche Inhalte enthält. Sie dürfen keine falschen Absenderangaben machen. Wir übernehmen keine Verantwortung für Feedback Dritter.
ABSCHNITT 12 – FEHLER UND UNGENAUIGKEITEN

(g) Spam, Kettenbriefe oder unerlaubte Werbung
(h) Imitation anderer Personen
(i) jegliche Nutzung, die anderen schadet oder die Services beeinträchtigt
Zusätzlich verboten sind:
(a) Verbreitung von Malware
(b) Reproduktion oder Ausbeutung der Services
(c) Sammlung personenbezogener Daten anderer
(d) Spamming, Phishing, Crawling oder Scraping
(e) Umgehung von Sicherheitsfunktionen
Wir können Ihr Konto jederzeit ohne Vorankündigung sperren oder kündigen.
ABSCHNITT 14 – KÜNDIGUNG
Wir können diese Vereinbarung oder Ihren Zugang zu den Services jederzeit und ohne Vorankündigung beenden. Sie bleiben für alle bis dahin entstandenen Gebühren verantwortlich.
Die folgenden Abschnitte überdauern die Kündigung: Geistiges Eigentum, Feedback, Kündigung, Gewährleistungsausschluss, Haftungsbeschränkung, Freistellung, Salvatorische Klausel, Verzicht, Gesamte Vereinbarung, Abtretung, Rechtswahl, Datenschutzrichtlinie und andere Bestimmungen, die ihrer Natur nach fortbestehen.
ABSCHNITT 15 – GEWÄHRLEISTUNGSAUSSCHLUSS
Die bereitgestellten Informationen dienen ausschließlich allgemeinen Informationszwecken. Wir übernehmen keine Gewähr für deren Genauigkeit oder Vollständigkeit. Jegliche Nutzung erfolgt auf eigenes Risiko.
SOFERN NICHT AUSDRÜCKLICH VON TOBIAS VISUALS ANGEGEBEN, WERDEN DIE SERVICES UND ALLE DARÜBER ANGEBOTENEN PRODUKTE „WIE BESEHEN“ UND „WIE VERFÜGBAR“ BEREITGESTELLT, OHNE JEGLICHE AUSDRÜCKLICHE ODER STILLSCHWEIGENDE GEWÄHRLEISTUNG, EINSCHLIESSLICH MARKTGÄNGIGKEIT, EIGNUNG FÜR EINEN BESTIMMTEN ZWECK, RECHTSMÄNGELFREIHEIT ODER DAUERHAFTIGKEIT.
Manche Staaten erlauben keinen Haftungsausschluss, sodass der obige Ausschluss möglicherweise nicht für Sie gilt.
ABSCHNITT 16 – HAFTUNGSBESCHRÄNKUNG
IM VOLLEN GESETZLICH ZULÄSSIGEN UMFANG HAFTEN WEDER TOBIAS VISUALS NOCH PARTNER, DIREKTOREN, MITARBEITER, LIZENZGEBER ODER SHOPIFY FÜR DIREKTE ODER INDIREKTE SCHÄDEN, EINSCHLIESSLICH ENTGANGENEN GEWINNEN, DATENVERLUST, ERSATZKOSTEN ODER ÄHNLICHES, DIE AUS DER NUTZUNG DER SERVICES ODER PRODUKTE ENTSTEHEN.
ABSCHNITT 17 – FREISTELLUNG
Sie stimmen zu, Tobias Visuals, Shopify und deren Partner von Ansprüchen Dritter freizustellen, die aus (1) Ihrem Verstoß gegen diese Bedingungen, (2) der Verletzung von Gesetzen oder Rechten Dritter oder (3) Ihrer Nutzung der Services entstehen.
Wir können die Verteidigung übernehmen, jedoch ohne Ihre Zustimmung keine Verpflichtungen auferlegen, die nicht finanzieller Natur sind.
ABSCHNITT 18 – SALVATORISCHE KLAUSEL
Ist eine Bestimmung dieser Bedingungen rechtswidrig oder nicht durchsetzbar, bleibt der Rest der Bedingungen gültig.
ABSCHNITT 19 – VERZICHT; GESAMTE VEREINBARUNG
Unterlassene Durchsetzung stellt keinen Verzicht dar.
Diese Bedingungen stellen die vollständige Vereinbarung zwischen Ihnen und uns dar und ersetzen alle früheren Absprachen. Unklarheiten werden nicht gegen die Partei ausgelegt, die die Bedingungen formuliert hat.
ABSCHNITT 20 – ABTRETUNG
Sie dürfen diese Vereinbarung nicht ohne unsere schriftliche Zustimmung übertragen. Wir dürfen sie ohne Einschränkung abtreten.
ABSCHNITT 21 – ANWENDBARES RECHT
Diese Bedingungen unterliegen dem Recht des Staates oder Territoriums, in dem Tobias Visuals seinen Hauptsitz hat. Beide Parteien stimmen der örtlichen Gerichtsbarkeit zu.
ABSCHNITT 22 – ÜBERSCHRIFTEN
Überschriften dienen lediglich der Übersichtlichkeit und haben keinen Einfluss auf die Auslegung.

Wir können diese Bedingungen nach eigenem Ermessen aktualisieren. Sie sind dafür verantwortlich, Änderungen regelmäßig nachzulesen. Wesentliche Änderungen werden gemäß geltendem Recht mitgeteilt. Die fortgesetzte Nutzung der Services gilt als Zustimmung zu den Änderungen.
